PENGATURAN INVESTASI ASING MENURUT TRADE RELATED INVESMENT MEASURES (TRIMs) 1994 DAN IMPLEMENTASINYA DI KABUPATEN TEBO PROVINSI JAMBI

ABSTRACT

One of the areas part of Jambi Province is Tebo Regency, where in Tebo Regency, Jambi Province has also implemented foreign investment. All of these provisions are in accordance with the rules regulated by TRIMs, besides that there are also provisions regulated in Law Number 25 of 2007 concerning Capital Investment. However, implementing foreign investment in Tebo Regency, Jambi Province creates obstacles. Problem formulation: (1) How are foreign investments regulated according to the 1994 Trade Related Investment Measures (TRIMs)? (2) How is Foreign Investment Implemented According to (TRIMs) 1994 in Tebo Regency, Jambi Province? Types of Sociological Legal research. The data sources used are primary data and secondary data. Data collection techniques used were document studies and interviews. Data was analyzed qualitatively. Research results: 1. Foreign investment regulations according to TRIMs 1994 which are regulated in Articles 1-5 TRIMs, PM Law No.25 of 2007 and Regional Regulation No.3 of 2023 as well as other provisions. Tebo Regency, Jambi Province has followed the implementation in accordance with the provisions stipulated in TRIMs. 2. The implementation of foreign investment according to TRIMs in Tebo Regency, Jambi Province has carried out one-stop integrated services, however in implementing the one-stop integrated service it is centralized and there are still several obstacles faced in implementing foreign investment in Tebo Regency, Jambi Province, including: weak data collection on foreign workers, limited infrastructure, fluctuations in investment value and minimal socialization of regulations to business actors. As well as obstacles that need to be considered in collecting data on foreign workers that is inaccurate or not reported properly, which can hinder the optimization of the benefits of foreign investment for the region.
