LEGAL PROTECTION FOR COMMITMENT MAKING OFFICIALS (PPK) WITH HEALTH BACKGROUNDS IN THE IMPLEMENTATION OF CONSTRUCTION WORKS AT THE PAYAKUMBUH CITY HEALTH OFFICE

Commitment Making Officers (Pejabat Pembuat Komitmen/PPK) in the implementation of construction projects at the Health Office of Payakumbuh City are often appointed from structural officials who have educational backgrounds in the health sector. The Commitment Making Officer (PPK) is an official authorized by the Budget User (PA) or the Budget User Authority (KPA) to carry out the procurement of goods/services and is responsible for the implementation of the contract. Substantively, this condition can create legal problems when the PPK is faced with construction works that are technical in nature. The formulation of the problems in this study are: (1) how the forms of legal protection for Commitment Making Officers (PPK) with a health background in the implementation of construction works; (2) what obstacles are faced by Commitment Making Officers (PPK) with a health background in the implementation of construction works; and (3) what efforts are made as a consequence of legal protection for Commitment Making Officers (PPK) with a health background in the implementation of construction works at the Health Office of Payakumbuh City. This research uses a sociological juridical method with a descriptive analytical approach. Data were obtained through literature studies and field research, including interviews and the collection of documents related to the implementation of health facility construction projects. The data were analyzed qualitatively. The results of the study show that the forms of legal protection available consist of two types, namely preventive legal protection and repressive legal protection. The obstacles faced by the Commitment Making Officers include: (1) lack of technical competence in construction; (2) the complexity of regulations related to government procurement of goods/services and construction services; and (3) legal risks and concerns about criminalization. Efforts made to address these issues include improving the competence of PPK in construction and government procurement of goods and services, as well as providing legal protection from the local government through the establishment of Standard Operating Procedures (SOP) as a form of preventive protection by the Inspectorate and the local government.
